Allowances


Magistrates are not paid for carrying out their duties, but may claim allowances, within specified limits, for the following types of expenses incurred as a direct consequence of their service:

1. Travel

Fares or mileage are paid to/from home/work and the courthouse for sitting and official duties, such as training.

2. Subsistence

Where time away exceeds stipulated limits, the cost of one or more meals may be claimed.

3. Financial Loss

An employer is required to permit an employee to have reasonable time off in order to perform magisterial duties but is not obliged to do so with pay. Where deductions from pay are made, loss of wages/salary may be claimed.
For the self-employed, loss of actual earnings or additional costs incurred may be reimbursed. Such losses/costs must however be actual, not just loss of opportunity, and be a direct and necessary consequence of magisterial duties.
